Summary of CBHD Patents Plan ?

    CHDA would like to invite the related essential patents holders to join the one-stop technical standard patents license, which combines essential patents holders of CBHD together so as to apply the new technology to related optical discs and devices more efficiently.
1、Purpose of establishing the patent pool
? To establish a pool of essential patents in China that are necessary for manufacturing the products based on CBHD-ROM Standard in order to provide users with fair, reasonable, nondiscriminatory access to as much essential patents as possible under one license.
　　2、Scope of essential patents
　　Essential patents may consist of issued or otherwise enforceable patents having one or more claims that are infringed by use or implementation of the CBHD-ROM Standard.
　　3、The quality of joining the patent pool
　　Any entity that believes it owns any essential patent of CBHD could apply to join the patent pool.
　　4、The procedure of confirming essential patents:
　　CHDA will organize independent patent specialists to evaluate the patents submitted by applicants. The patents that determined to be essential will be put into patent pool. CHDA also facilities the evaluation process, convenes the initial group of essential patent (and patent application) holders and processes their deliberations to conclude the terms of a joint license.
　　5、Patent pool management:
　　Patent license manager shall be selected from initial patent (and patent application) holders and will be granted to the non-exclusive patent license. Meanwhile, a management committee, which is composed of the essential patent holders, the representatives of public interest and patent implement part, will be established to supervise the patent license manager.
